AFFILIATE APPLICATION
Your acceptance indicates that you have carefully read this Agreement and that you willingly accept all Whole in One Products (COMPANY) Terms and Conditions, Policies and Procedures.
I understand that no fee or initial product purchase is required or is a means by which to become a Whole in One Affiliate.
Any Affiliate in the Whole in One Affiliate program may remove and cancel his affiliation at any time, regardless of reason. Affiliate removal may be submitted in writing to: 12707 High Bluff Dr suite 140, San Diego CA 92130, or via email to info@wholeinoneorganics.com
TERMS & CONDITIONS
I am of legal age in the state of my residency. I agree that I am an independent contractor, responsible for determining my own business activities and not an agent or employee of the COMPANY. I am responsible for the payment of all federal and state self-employment taxes and any other tax required under any federal, state or regulatory taxing agency.
As a Whole in One Affiliate I will not directly or indirectly offer any consideration or incentive for any commission earning activity to customers.
As a Whole in One Affiliate I will make no promises or claims to the effect that any of Whole in One products have been approved or endorsed by any regulatory agency.
I understand that my Affiliate position cannot be transferred or assigned without written consent of the COMPANY.
This Affiliate position does not constitute the sale of a franchise or of a Distributorship and no fee, sales aids or services purchase or initial wholesale product purchase has been required of me for participation as an Affiliate.
In presenting Whole in One Products to prospects, I agree that such presentations shall be directed to either my affiliate or corporate websites only. At all times affiliates are to maintain the professionalism and integrity of the Corporation. Any non-conforming practices will lead to termination as an Affiliate.
PROHIBITED OPERATIONS
I SHALL NOT purchase or register search engine keywords, Ad Words, search terms or other identifying terms that Whole in One considers in its sole discretion to fall into the following categories:
* promote illegal activities.
* promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age.
* promote sexually explicit materials.
* promote violence.
* promote firearms or weapons.
* promote fake or counterfeit items
* promote gambling or betting
I will not send unsolicited information or material to another computer.
I will not divert a user to another site not requested by the user.
I may not use affiliate links on any Whole in One Products owned page to promote any links or products of anyone else I am affiliated with.
I will not promote my Affiliate status or business nor use the COMPANY name, or the trade names, logos, sales materials, trademarks or service marks of Whole in One Products, Inc., except in materials provided by the COMPANY or approved in writing by Whole in One prior to their use by me. I understand that unauthorized use of duplication of trademarks or copyrighted materials is a violation of federal law.
Whole in One provides the following fulfillment to its Affiliates: Shipment of ordered products within ten days of receipt of order and clearance of funds, subject to availability of items ordered; calculation and payment of Affiliate commissions. Commissions are payable to Affiliates according to the Compensation Plan which is incorporated herein by reference.
Affiliate and customer lists and names are owned by the COMPANY and may never be used for any commercial or business purpose without prior written consent of COMPANY. During the term of this Agreement and anytime thereafter, Affiliates shall not, directly or indirectly solicit customers of Whole in One for any purpose.
I will not make false or misleading statements about Whole in One, my Affiliate position or COMPANY products. I will at all times conduct myself as an Affiliate in a professional, courteous, fair and ethical manner.
Whole in One may amend these Terms and Conditions and provide additional Policies and Procedures for Affiliates from time to time, as well as possible modification of the Affiliate Compensation Program. Such modifications and additions and Compensation Plan modifications, and all changes thereto, shall become a binding part of this Agreement upon publication on the official Whole in One Affiliate website. Whole in One will notify all Affiliates by sending an email to your address of record.
This Agreement is governed under the laws of the State of California. As a Whole in One Affiliate you are agreeing to be bound by the terms in these Terms and Conditions. The parties agree that any claim, dispute or other difference between them shall be exclusively resolved by binding arbitration pursuant to the Commercial Rules of the American Arbitration Association with arbitration to occur in San Diego, California.
POLICIES & PROCEDURES
Affiliate Enrollment Policies & Procedures
Any individual, or business entity, wishing to become an Independent Affiliate of the COMPANY may enroll via the Internet at www.wholeinoneorganics.com. Individuals may only enroll ONE time.
Retail Sales Via Replicated Website
When a retail customer visits an Affiliate's website and purchases product at retail, the COMPANY will process the transaction and ship the product to the retail customer.
Laws, Ordinances, & Regulations
Affiliates shall comply with all laws and regulations in the conduct of their business.
Removal
The COMPANY, at its sole discretion, may terminate or suspend an Affiliate for materially breaching the Terms, Conditions, Policies, or Procedures contained herein. An Affiliate that has been terminated or suspended may submit an appeal to the COMPANY for review. Upon receipt of such appeal the COMPANY shall, at its sole discretion, consider the matter and reply to the Affiliate within a reasonable period of time. Any Affiliate who voluntarily terminates their position may return as an Affiliate at any time.
Product Purchases
The COMPANY only accepts orders via the COMPANY Website (www.wholeinoneorganics.com), or the 24 hour fax order line (858) 481.8566 The COMPANY only accepts credit cards (Visa, MasterCard, Discover Card, or American Express), or check debit cards bearing the Visa or MasterCard logo, as payment. To prevent credit card misuse, and for the protection of our Affiliates, Retail Customers, and the COMPANY, orders can only be shipped to the credit card BILLING Address that the card holder has on file with the bank or financial institution. Whole in One does accept personal checks, telephone orders, and mail in orders after the clearance of funds
Return Policy & Refund Procedure
All Whole in One products carry a 30 day, unconditional, 100% money back guarantee of satisfaction. The 30-day period begins on the date that products were delivered or received by the customer.
To return merchandise, the Retail Customer, must notify the Company via email to info@wholeinoneorganics. Upon receipt of properly returned merchandise, the COMPANY will issue credit back to the customer by applying the refund to the same card that was used in the purchase. (Please allow 2 weeks for processing).
By continuing with the enrollment process you hereby certify that you meet the requirements set forth to become an affiliate and that you have read, understand, and agree to be bound by all of the Whole in One terms, conditions, policies and procedures.
